Introducing new evidence in criminal case appeals is guided by several legal standards created to ensure the judicial process is fair and final. This means applicants should demonstrate that the evidence was unavailable during the first trial.

  • Likely to change the verdict

The court also considers the appeal only if the new evidence can change the initial verdict. Courts often assess the probable impact of new evidence on the original verdict.
