Omaha Activist & Entrepreneur David Mitchell Acquitted of Three Charges

In 2019, officers from both the Omaha and Lincoln police departments worked together to storm David Mitchell’s video gaming storefront in Lincoln, Nebraska. Former Gamers employee Anthony Rodriguez moved on to stealing from a competitor in Omaha, Nebraska, after being dismissed from Gamers for theft. The company’s name, “Game Room,” reflects its identity as a novel workplace. Upon his arrest, he claimed that “David Mitchell put him up to it.”

Without any evidence or proof, Robert Wiley, a crooked investigator, barged into Mitchell’s business and arrested the store manager. The investigator then fabricated a criminal complaint, stating that he had Facebook messages and videos to cooperate with David’s statement, resulting in David’s arrest. That’s the farthest thing from the truth. Three years and over $100,000 more in legal expenses later, the prosecutor’s office dismissed the case two weeks before trial, despite the defendant having rejected more than ten plea deals. The trial was set to begin on August 29th, 2022.

A jury in the Douglas County district court decided towards the end of 2021 that the former Omaha city council candidate and activist did not commit the sexual assault charge against him. In 2014, charges were brought against Mitchell on two offenses. As Omaha World Herald and his lawyer Michael Cannon reported, there was no evidence or proof.

As an activist, David Mitchell’s primary focus is on enhancing North Omaha’s ability to better support itself economically. North Omaha is in desperate need of jobs in the service sector that can provide long-term employment and pay well. Because he has lived in North Omaha, he is familiar with the experience of having to go to work rather than choosing the more direct route. Mitchell is a staunch advocate for a diverse variety of issues, including the improvement of education, the reduction of the disproportionately high number of African Americans incarcerated, and the battle to stop gentrification. He is also an outspoken opponent of gentrification.
